These Terms of Service (the “Terms”) govern your access to and use of this website and the assessments, coaching programs, and related services offered by Courtney-Brooke Johnson Coaching (“we,” “us,” or “our”). Please read them carefully.

Acceptance

By accessing this website, booking a discovery call, or engaging our services, you agree to be bound by these Terms. If you do not agree with any part of them, please do not use the website or our services. If you are entering into these Terms on behalf of a company or other organization, you represent that you have the authority to bind that organization.

What coaching is, and isn’t

Coaching is a forward-looking, collaborative process focused on your professional goals, leadership, and growth. It is not therapy, counseling, psychotherapy, or medical or mental-health treatment, and it is not a substitute for professional medical or psychological care.

We are not acting as a physician, psychologist, psychotherapist, licensed counselor, financial advisor, or attorney, and nothing in our services should be interpreted as advice in those domains. If you are experiencing a medical, psychological, or mental-health condition, or if you are in crisis, please seek the support of a licensed professional or contact your local emergency services. By engaging our services you acknowledge that coaching does not diagnose, treat, or cure any condition.

No guaranteed outcomes

Coaching is a partnership, and your results depend on many factors, including your own effort, circumstances, and decisions. Results vary from person to person. Nothing on this website or in our services promises, guarantees, or warrants any specific result, outcome, income, promotion, or level of success. Any examples or descriptions of outcomes are illustrative only and are not a guarantee of what you will achieve.

The services

Our services may include assessments (such as the Energy Leadership Index) and one-on-one or group coaching programs. The specific scope, format, and duration of an engagement are described during a discovery call and confirmed in a separate coaching agreement.

Investment and the structure of any engagement are discussed on a discovery call. We do not publish prices on this website; the appropriate program and investment are determined based on your goals and the scope we agree upon together.

Scheduling, payment & cancellation

The specific terms for scheduling, payment, rescheduling, and cancellation are set out in your individual coaching agreement. As a general matter:

• Sessions are scheduled by mutual agreement, and we ask that you provide reasonable advance notice if you need to reschedule.
• Fees are due according to the schedule stated in your coaching agreement. Payment plans may be available for certain programs.
• Missed sessions without adequate notice may be forfeited, and cancellation and refund terms are governed by your coaching agreement.

Where the terms of a signed coaching agreement differ from this section, the coaching agreement controls.

Intellectual property

Core Energy™, the Energy Leadership Index (ELI), the ELI Master Practitioner (ELI-MP) designation, and related names and marks are owned by the Institute for Professional Excellence in Coaching (iPEC) and are used here under iPEC certification. We claim no ownership of those marks.

All other content on this website (including text, design, graphics, frameworks, and materials we provide to you) belongs to Courtney-Brooke Johnson Coaching or its licensors and is protected by applicable intellectual-property laws. You may not copy, reproduce, distribute, or create derivative works from this content without our prior written permission, except as permitted for your own personal, non-commercial use.

Disclaimers & limitation of liability

This website and our services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the website will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, Courtney-Brooke Johnson Coaching and its representatives will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of this website or our services. To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the services will not exceed the amount you paid to us for the services giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

Governing law

These Terms are governed by and construed in accordance with the laws of the State of New York, USA, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or our services will be subject to the exclusive jurisdiction of the state and federal courts located in the State of New York.

Changes

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Material changes will be reflected on this page, and your continued use of the website or our services after changes take effect constitutes acceptance of the updated Terms.
